Moto Video Ltd ("Moto", "we", "us") values your privacy. This Privacy Policy explains how Moto collects, uses, stores, and protects Personal Data in connection with the Service. Moto is intended for business use only and may not be available in all jurisdictions.

For purposes of this Privacy Policy, "Personal Data" means information relating to an identified or identifiable person, and includes any term of similar meaning under applicable privacy and data-protection laws. Moto acts as the database owner or controller, as applicable, for account, billing, website, and business-contact data. For Customer prompts, uploads, files, inputs, and Generated Content, Moto processes such data only as necessary to provide the Service, unless otherwise required for security, abuse-prevention, legal, or technical reasons.

1. How Do We Collect Personal Data?

We collect data through your use of our website and the Service; meaning by the way you browse and use our site, how you use the Service through your account, the information you fill out in registration, contact, billing, support, and other forms, and the content you submit to the Service in order to generate outputs. We may also receive limited billing, subscription, tax, fraud-prevention, and transaction information from payment providers, merchants of record, banks, and service providers, or from business contacts who communicate with us on behalf of the Customer.

2. What Personal Data Is Retained About You?

Account data: the information you provide when registering and authenticating, such as your name, email address, company name, role, business contact details, account credentials, authentication information, and account settings.

Usage data: statistical information about your use of the website and the Service, such as the pages you viewed, the links you clicked, your device and browser type, visit times, IP address, referral source, approximate location derived from technical data, log data, error reports, as well as your subscription plan, credit consumption, and generation activity (e.g., type and volume of generations).

Content data: the prompts, instructions, files, inputs, and text, images, or video generated for you. Customer prompts, uploads, files, inputs, and Generated Content are processed transiently and in a secure manner as necessary to generate the requested output, and are deleted shortly after generation is completed, subject to limited retention where necessary for technical processing or delivery, security, abuse prevention, legal compliance, billing disputes, or enforcement of an applicable agreement.

Payment and billing data: payments may be processed by our third-party payment provider, merchant of record, or by Moto directly. We do not store your full payment card details where payment is handled by a third-party payment provider or merchant of record. We may receive and retain confirmation of payment, subscription status, invoice details, tax information, billing address, payment method type, transaction identifiers, and limited billing information needed to operate your account, comply with law, resolve disputes, and maintain financial records.

Communications and support data: information you provide when you contact us, submit a complaint, request support, respond to notices, or communicate with us, including message content and contact details.

3. What Non-Personal Data Is Retained About You?

We retain some non-personally identifiable data, including aggregated browsing and usage statistics, your browser and operating system type, and technical information about how the Service performs on your device, provided that you were notified of such collection or retention. This data is used in aggregate to operate, secure, analyze, and improve the Service.

4. How Do We Process Your Personal Data?

We process Personal Data in order to: provide the Service and generate the outputs you request; authenticate your account and secure it; meter your credit usage and administer your subscription; process payments, direct invoices, taxes, refunds, and chargebacks; operate, secure, troubleshoot, and support the Service; prevent fraud, abuse, unlawful content, and violations of our terms; investigate complaints and enforce our rights; comply with legal, tax, accounting, and regulatory obligations; and contact you with service, security, billing, legal, and operational notices.

We may also contact you with updates and marketing communications regarding our services, which you may opt out of. Moto does not use Customer prompts, uploads, files, inputs, or Generated Content to train or fine-tune AI models.

6. Retention

Moto retains Personal Data only for as long as reasonably necessary for the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. Account, subscription, invoice, tax, and transaction records may be retained for the period required under applicable tax, accounting, and legal recordkeeping requirements. Security logs, fraud-prevention records, abuse-prevention records, and support records may be retained for a reasonable period necessary to protect the Service, resolve disputes, enforce agreements, and comply with law.

Customer prompts, uploads, files, inputs, and Generated Content are processed transiently and deleted shortly after generation is completed, subject to limited retention where necessary for technical processing or delivery, security, abuse prevention, legal compliance, billing disputes, or enforcement of an applicable agreement. Aggregated or anonymized data that no longer identifies a person may be retained without time limit.

7. Do We Use Cookies In Our Service?

A cookie is a small file stored on your computer which is used in the interaction between your computer and our servers (or third-party servers). Moto uses cookies and similar technologies that are necessary to provide the Service, including for login, authentication, session management, security, fraud prevention, preferences, and account functionality. Moto does not use non-essential advertising cookies unless disclosed separately and, where required by applicable law, subject to consent.

On the public website, Moto records aggregate page and video-event counters by date, page, video milestone, referring domain or campaign source, and coarse country. These counters do not use cookies or persistent visitor identifiers, and the analytics record does not store IP addresses, full referrer URLs, or user-agent strings.

8. Who Has Access to Your Data?

We provide access to Personal Data only to personnel, contractors, and service providers who need access for the purposes described in this Privacy Policy and who are subject to confidentiality, security, or contractual obligations. Access is limited according to role and business need and may be monitored for security and compliance purposes.

9. Which Third Parties Do We Use to Process Personal Data?

We use third-party service providers to operate the Service, including cloud infrastructure, hosting, security, logging, analytics, content delivery, AI processing, payment, invoicing, tax, fraud prevention, email, customer support, and professional advisers. These providers may process Customer data only as necessary to provide their services to Moto, support operation of the Service, comply with law, or protect rights and security.

We may also disclose Personal Data where required by law, court order, regulator, law-enforcement request, tax authority, or legal process; where necessary to protect rights, safety, security, or property; in connection with a merger, acquisition, financing, corporate reorganization, sale of assets, or similar transaction; or with the Customer's instruction or consent.

10. Cross-Border Transfers

Moto is based in Israel and may process, store, or transfer Personal Data in Israel and in other countries where Moto, its affiliates, or its service providers operate. These countries may have data-protection laws different from those in the Customer's jurisdiction. Where required by applicable law, Moto will use appropriate safeguards for cross-border transfers, such as contractual commitments, processor obligations, security measures, or other lawful transfer mechanisms.

11. Security

Moto uses reasonable technical, organizational, and administrative measures designed to protect Personal Data against unauthorized access, disclosure, alteration, loss, misuse, and destruction. These measures may include access controls, authentication, encryption or secure transmission where appropriate, logging, confidentiality obligations, vendor controls, and security monitoring. No online service can guarantee absolute security, and the Customer is responsible for maintaining the confidentiality of account credentials and limiting access to authorized users.

12. How Can We Contact You?

We may contact you by email, in-product notice, website notice, or other reasonable means regarding the Service, including account, billing, security, legal, support, operational, and policy updates. We may send periodical newsletters and updates regarding the Service; you may opt out of marketing communications at any time, but we may continue to send non-marketing service notices.

13. Privacy Contact

Privacy-related questions, requests, complaints, legal notices, and support requests may be sent to support@usemoto.app. You may also contact us to request access to, correction of, or removal of your Personal Data, subject to applicable law. The Customer is responsible for ensuring that its account contact details remain current so that Moto can communicate privacy, security, and legal notices.

14. What Can You Do If You Feel Your Privacy Was Invaded?

If you feel your privacy was invaded, you can contact us by email and file a complaint. We will inspect complaints within a reasonable time and respond promptly. You may also have the right to contact the applicable privacy regulator or other competent authority, subject to applicable law.
